Wollongong Mediation Centre


Mediation services are provided by professionals. Successful mediation requires skill and knowledge. Clients of the Wollongong Mediation Centre can certainly benefit from the exposure and experience that the mediator has as a family law practitioner with many years’ experience and accreditations in family law and children’s law.

Mediation is not free. Usually the parties to a dispute share equally in the costs of mediation although in some cases the parties might agree that one party pays for all of the mediation process. In any event, the cost of a mediation is certainly much lower than the cost of litigation.

Even organisations which have Commonwealth Funding for mediation (such as Family Relationship Centres) only offer free mediation for the first three (3) hours. After that the parties must pay for their mediation.

Many people are prepared to pay for private mediation because of the experience and expertise of the mediator and because appointments are available much earlier than in Government funded organisations throughout Wollongong and the Illawarra.

In terms of outcome, Wollongong Mediation Centre has a success rate of above 80%. People pay for private mediation because it works; the experience and expertise of the mediator assists the parties to an early resolution of the dispute. The fees charged by the Wollongong Mediation Centre are set out below:

PARENTING DISPUTES

STEP 1: Preparation for Mediation
  • Request for mediation.
  • All telephone attendances on both parties and/or solicitors for the parties to arrange or attempt to arrange a mediation session.
  • Introductory letter to initiating party enclosing Intake Risk Assessment Checklist.
  • Invitation letter to other party enclosing Intake Risk Assessment Checklist.
  • Considering responses from both parties to determine whether the dispute is suitable for mediation.
  • Issuing 60I Certificate to initiating party if the other party refuses or fails to engage in mediation, or if the matter is deemed unsuitable for mediation.

    STEP 1 COST - $275.00 (incl GST)
    (paid by initiating party)
STEP 2: The Mediation
  • Book in and confirm the mediation after speaking with the other party (to commence no later than 1pm).
  • Convening a joint mediation session for up to 4 hours.
  • Issuing 60I Certificate for attendance at mediation.
  • Drafting, typing and checking documentation including Heads of Agreement, a Parenting Plan, Terms of Settlement or Consent Orders, as required.
  • Amending draft documentation.

    STEP 2 COST - $1,450.00 (incl GST)
    (the parties are asked to share this cost equally)
STEP 3: Additional Time
    If no agreement is reached after 4 hours, for additional time added on, or at a subsequent settlement conference convened later.
    STEP 3 COST - $175.00 per hour per party (incl GST)
Cancellation Fees
    If a mediation has been arranged for you and is cancelled without reasonable notice then this may incur a cancellation fee being $250.00 per person.

PROPERTY DISPUTES

(WITH OR WITHOUT LAWYERS IN ATTENDANCE)


STEP 1: Arranging and convening Mediation
  • Request for mediation (by phone or email); or
  • Perusing correspondence from parties requesting mediation
  • All telephone attendances with both parties and/or solicitors for both parties
  • Arranging mutually suitable date and time for mediation
  • Sending out confirmation letters and schedules of fees
  • Perusing agreed Joint Balance Sheet, Outline of Case Documents and any Court documents filed by the parties
  • Convening a joint mediation session with the parties and their lawyers lasting up to 4 hours

  • STEP 1 COST - $2,035.00 per party (plus GST)

  • Most mediations are completed within the 4 hour time allocated
STEP 2: Additional Time
    If no agreement is reached after 4 hours, for additional time added on, or at a subsequent settlement conference convened later.
    STEP 2 COST - $440.00 per hour per party (plus GST)
Cancellation Fees
    If a mediation has been arranged for you and is cancelled then we may charge a cancellation fee being $250 per person. If you need to reschedule then we will change a reschedule fee of $100.

PARENTING AND PROPERTY DISPUTES

(ATTENDING WITH OR WITHOUT LEGAL REPRESENTATION)

    Our charges for this effectively offer a discount; and are as follows:
  • Option 1: Combined property and parenting mediation session on the same day (commencing 9.30am) and lasting up to 6 hours (including a break) - $5,200.00 (incl. GST)

  • Option 2: Two separate mediation sessions on separate days (each session lasting up to 4 hours) - $5,550.00 (incl. GST)
